The short answer is yes.
Personal Injury attorneys almost always charge a "contingency fee contract." That is the type of contract that we use. The idea is that the injured person does not have to dig into his or her pocket to pay the attorney either a "flat fee" or an "hourly rate." Most Personal Injury attorneys, like us, charge a percentage of the money collected on behalf of our clients. That fee varies from attorney to attorney. We charge 33 percent of all money recovered if the claim is settled without filing a lawsuit. If we file a lawsuit, the fee goes to 40 percent of all money recovered. We front the expenses that we believe are necessary to successfully pursue the claim and we are reimbursed from the client's percentage upon the successful resolution of the claim.
If we are unsuccessful, then the client does not owe us any money for attorneys' fees or for costs expended.
Although all claims are not successful, no attorney would take a claim that he or she did not believe that would be successful.
